  • “Property ownership issue.” Ito umano ang pangunahing dahilan kung bakit na-delay ang konstruksyon ng P190-million New Public Market sa Bgy Mandaragat, Puerto Princesa City.

Sa pagtatanong ng mga miyembro ng City Council kay City Engineer Alberto P. Jimenez Jr, sinabi niya na noong magtatayo na sana ng gusali ang kontraktor na Square Meter Trading and Construction Corporation ay biglang may lumutang na isang Ms Pacho na umaangkin sa reclaimed area kung saan itatayo ang bagong palengke kaya nagdesisyon ang kanilang tanggapan na ilipat ito sa may bodega ng San Miguel Corporation.

“When we started the layout of the project, there was a claimant of a portion of the reclaimed area. It seemed about 4,000 square meters of that property belongs to that private party and the original layout was adjusted, which affected the positioning of the foundation. We moved about more than nine meters towards the bodega of San Miguel Corporation that changed the positioning of the structure and also affected the foundation layout,” ayon kay Jimenez.

Ginawa umano nilang lumipat ng lugar bilang pagrespeto sa umaangkin at dahil iniisip nila na matatagalan ang proyekto kung iintindihin pa nila ang usapin.

“Respeto na rin sa pagki-claim niya ay kami na lang ang umurong. Iniisip kasi namin na magtatagal ang usapin yung settlement ng boundary kung i-entertain namin ang claim niya, maka-apekto sa original layout ng building,” giit pa ni Jimenez.

Inamin naman ni Jimenez na walang pormal na pakikipag-ugnayan sa kanilang tanggapan ang kaniyang tinutukoy na si Ms Pacho at tanging sa report lamang ng kanilang mga surveyor niya ito nalaman.

Kinumpirma niya rin na hindi sila humingi ng legal opinion sa City Legal office hinggil dito at iginiit na noong panahong nagkaroon ng bidding para sa proyekto ay walang lumulutang na claimant sa lugar.

Sa pagtatanong naman ni City Councilor Herbert Dilig kung ito ay nabiripika sa City Assesor’s Office o CAO, inamin ni Jimenez na walang nakitang property sa lugar ang CAO dahil ito ay isang reclaimed area.

Magkagyunman, nililinaw niya na hindi pa tumitiklop ang tuhod ng City Hall laban sa umaangkin. “Actually we are not giving up our claim over the land. It’s just that building was adjusted to avoid the issue of ownership,” dagdag pa ni Jimenez.

Samantala, tiwala naman si Jimenez na kaya pang tapusin ng kontraktor ang gusali sa panibagong ekstensyon na ibinigay sa kanila.
