Sa kabila nang hindi naging positibo ang resulta ng kasong isinampa ng Pamahalaang Panglungsod ng Puerto Princesa sa pamunuan ng Palawan Electric Cooperative, hindi ito nawawalan ng kaparaanan para ipagpatuloy ang nasimulang laban.
Nakatakdang iakyat ng pamahalaang local ng Puerto Princesa sa Court of Appeals ang kaso laban sa PALECO matapos maglabas ng order ang Regional Trial Court Branch 52 na dismissed ang kaso.
Matatandaan na taong 2019 nang magsampa ng kaso ang City Government laban sa kaugnay sa patay sinding kuryente at pagkasira ng mga (appliances).
Ayon kay Atty. Norman Yap, City Legal Officer, taong 2020 nang ilabas ng RTC BRANCH 52 ang partial dismissal laban sa PALECO dahil sa ang National Electrification Administration (NEA) umano ang nagtalaga ng mga taong bumubuo ng management ng PALECO.
Sa pahayag ng naturang abugado” I think during the last quarter of 2020 the Regional Trial Court Branch 52 ordered the partial dismissal to the complaint, holding that jurisdiction over the case belong to the National Electrification Administration (NEA), not with the Trial Court. We filed for the motion for partial reconsideration as certain that there are grounds to resolve immediate judicial action and it’s not fair to refer us to the NEA. Considering that NEA is the one appointing the management of PALECO so it is not a partial tribunal as far as their concern”.
Kaugnay nito, mariing hinihiling sa pamamagitan ng resulosyon na isinusulong sa Sangguniang Panglungsod na i-apela ang kaso ang City Government sa Court of Appeals sa pag dismissed ng kaso laban sa PALECO.
Ang titulo “A Resulotion Requesting Sangguniang Pangulungsod to authorize the City Government to file a temporary case before the Court of Appeals,” bukod pa sa pagnanais ng City Legal Officer na kuwestiyunin ang RTC Baranch 52 sa ginawang pagdismissed sa kabila ng pag-apela ng pamahalaang local noong 2020 ng motion for partial reconsideration sa kaso.
“Basically, this year the Regional Trial Court denied the motion for partial reconsideration, and has now decided to dismissed the case entirety, so I consulted the City Administrator Atty. Arnel Pedrosa and he said we should go up to the court of appeals to file a temporary proceeding to certain dismissal against Palawan Ele4ctric Cooperative,” pagtatapos na pahayag ni Atty. Norman Yap.
