Pres. Duterte approves law allowing ‘night shift differential pay’ to gov’t employees

President Rodrigo Duterte has approved into law the grant to night differential pay of government employees, including those in government-owned or controlled corporations, assigned on April 13, but was just declared to the media and public today, Monday, May 16.

The new law says that the government employees, whether they are permanent, contractual, temporary or casual, shall be entitled to a paid “night shift differential” of a maximum of 20% of their hourly basic rate which covers all hours of work between 6:00 PM to 6:00 AM.

It was also said that the hourly basic rate refers to the basic salary rate per hour as derived by dividing their basic monthly rate by 22 working days, dividing the quotient by eight hours.

However, the new order also entails the classification for the employees who are not covered by it:

Those whose schedule of office hours fall between 6:00 AM to 6:00 PM – services rendered beyond the regular eight-hour work schedules are paid overtime pay.

Those whose services are required or are on-call 24-hours a day such as uniformed personnel of the Armed Forces of the Philippines, Philippine National Police, Bureau of Jail Management and Penology, and Bureau of Fire Protection.

It was also said that the funds for the implementation will be charged in the existing appropriations of the national government entities in the General Appropriations Act.
