Wala umanong naipakitang kaukulang permit ang grupo ng isang doktor at kilalang mga personalidad sa lalawigan sa pangongolekta at pagmamay-ari ng mga taklobo nang makipagpulong ang mga ito sa Palawan Council for Sustainable Development Staff (PCSDS) kahapon, April 16, 2021.

“As Dra. [Rosalee] Tequillo and her group failed to provide legal basis for their activities and operations, the PCSDS maintain its position that their collection, possession and trading of giant clam species are illegal and are punishable under Republic Act No. 9147 or the Wildlife Resources Conservation and Protection Act,” ang bahagi ng press release ng PCSDS ngayong araw.

Sa nasabing press release, na ipinaskil ng PCSDS Staff sa kanilang social media page ngayong araw, nakasaad na may natangagp silang impormasyon na may grupong nangunguna sa pagsasagawa ng iligal na bilihan ng giant clams (taklobo) sa Palawan. Matapos nito ay nakatanggap sila ng request para sa isang meeting mula kina Ceasar Ventura at Dra. Rosalee Tequillo. Nakipagpulong naman umano sa kanila si PCSDS Executive Director Teodoro Jose Matta, kasama ang PCSDS Enforcement at Legal Services Section staff kahapon, April 16, 2021.

“Dra. Tequillo’s repeated mention about National Redemption Program which according to her is a team of European buyers, inclines the PCSDS to believe that their activity is not for scientific or breeding or propagation purposes but for commercial purposes,” ang nakasaad pa sa post.

Una nang ipinaliwanag ng PCSDS na nag-ugat ang usapin sa ibinabang Memorandum ng Bureau of Fisheries and Aquatic Resources (BFAR) na pirmado ng pambansang direktor. Ayon rito, kasabay ng pagsasagawa ng inventory sa mga nakumpiskang fossilized giant clam na nakalagak sa mga warehouse ng Provincial-BFAR, hindi muna magsagawa ng raid ang mga kinauukulan. Ito umano ang ginawang kasangkapan ng mga namimili ng shells ng taklobo.  Sa nasabing Memorandum na naka-address sa lahat ng regional director ng BFAR, hindi nakasaad na pinapayagan na ang pangunguha ng buhay o nakatambak na fossilized clam sa mga karagatan o kalupaan.

PINAHINTULUTAN UMANO NG OP, BFAR

“Also, Dr. Tequillo’s claims that they collect only the fossilized Giant Clam species and that their activities are sanctioned by the Office of the President (OP) and the Bureau of Fisheries and Aquatic Resources (BFAR) are not supported with any valid documentary evidence. Dra. Tequillo even admitted that she does not have in her possession any documents showing that the National Redemption Program is a sanctioned program of the OP.”

Ipinakita lamang umano ni Tequillo ang isang dokumento na umano’y galing kay BFAR National Director Eduardo Gongona, iyon ang pinanghahawakan nilang dokumento sa pangongolekta at pagmamay-ari ng taklobo.

Ngunit nang siyasatin ng PCSD ang dokumento ay hindi umano ito nagbibigay ng kapangyarihan kay Tequillo at sa kanyang grupo sa kahit anumang kapamaraanan para mapayagan silang mangolekta, mag-extract, at mag-angkin ng fossilized Giant Clam species. Ang ginagawa umano nilang iyon ay may katumbas na parusa sa ilalim ng batas.

PWEDE BA ANG TREASURE HUNTING PERMIT?

Binanggit umano ng doktora ang isang Mr. Joel  Pamaran na ayon sa kanya ay mayroong  Treasure Hunting Permit na nag-offer sa kanila na i-extend sa kanila ang hawak niyang permit ngunit wala naman umano siyang maipakita na ganoong permit.

Ipinaliwanag naman umano ng PCSDS sa kanila na sa ilalim ng existing rules and guidelines ng National Museum (NM), ang  natural history specimens gaya ng giant clam species ay hindi kasama sa treasure Hunting Permit at ang pinapayagayang pangunguha lamang dito ay para lamang sa reference collection at/o para sa taxonomic study at hindi para ibenta.

Ipinaalaala rin ng PCSDS kay Tequillo at sa kanyang grupo na sa Palawan, ang PCSDS ang lead agency sa pagpapatupad ng Wildlife Act. At lahat ng mga aktibidades kaugnay sa Wildlife species, by-products and derivatives ay regulated ng PCSD.

“During the discussion, the PCSDS also learned that Dra. Tequillo submitted to BFAR a list of individuals who have stockpile of giant clam. PCSD reiterates its warning that those individuals can be charged under the Wildlife Act.”

PAGSASAMPA NG KASO

Sa hiwalay namang panayam ng Palawan Daily News  team, ibinahagi ni PCSDS Executive Director Teodoro Jose Matta ang ilang highlight ng naturang meeting at binanggit ang ilang kilalang personalidad sa Palawan.

“They claimed they were under the authority of the National Redemption Program, from Malacañang.  That there was a European buyer of taklobo and that Malacañang was spearheading the effort thru the NRP.  They also claimed that they have authority from BFAR. However, when we asked for proof of this NRP and their BFAR authority- they failed to show [to us] any legal documentation,” ani Matta.

Aniya, wala silang maipakitang dokumento at tanging tarpaulin lamang na kahalintulad din sa nagkalat na nakapaskil na tarpaulin sa Green Island, Roxa kung saan nasabat ang P1.2 bilyong halaga ng fossilized giant clam kahapon.

Sa ngayon ay pinag-aaralan naman umano nilang masampahan ng kaso ang involved na mga indibidwal.

Kaugnay nito, magko-convene ang Provincial Law Enforcement Task Force sa Lunes upang pag-usapan ang gagawing hakbang para sa nasabing grupo.

SAGOT NG KAMPO NG DOKTORA

Ayon naman kay Dr. Tequillo sa hiwalay na panayam, binanggit niyang maghintay na lamang ang publiko sa susunod na linggo sa anumang development dahil makikipag-ugnayan umano ang national team sa PCSD.

“The national team will communicate with PCSD. Just know that fossilized clams dug from the ground, farms and mountains are different from fresh clams from the sea.  I don’t want to preempt the National Team and BFAR National Technical Working Group,”  ani Dra. Tequillo sa pamamagitan ng chat message.
